Before Vice Chancellor M'Coun. DECISION. Edward Boirgirard vs. John Delafield. Presdt. &c. and others.-This was a petition for an injunction on the New York Banking Co. and the appointment of a receiver. The petitioner avers that the bank owes him $90,000 a $100,000, being the balance on ad vauces made for cotton to be sent to Havre from Mississippi. but which was not sent in coasequence of the Hernando Railread Co (with whom the New. York Banking Co. had agreed) failing in their engagemeats. It is also averred by the petitioner that the President is largely indebted to the institution. that it did not make return HE accordance with law to the Legislature last Jannary (it has been winding up since September) and that it should pass into the hands of a receiver. The Stockholders contend that the Company is perfectly solvent. and can pay all its eagagements. Ordered, that the injunction be allowed. and a receiver appointed.

0 OFFICE OF THE NEW YORK BANK NOTE LIST, 208 BROADWAY, N. Y.-Subscribers are informed that an injunction has been placed upon the New York Banking Company of this city, and a receiver appointed. The bills are no longer redeemed. CHARLES McINTYRE & CO. New counterfeit five dollar bills on the Bank of Lyons, New York, dated May 4, 1840, payable to H. Holmesvignette cattle and railroad with cars in the distance. Terms of subscription to pamphlet two dollars per annum.

# NOTICE -NEW YORK BANKING COMPANY The subscriber having been appointed Receiver of the property, claims, funds and effects of the New York Banking Company, an association formed under and in pursuance of an act of the Legislature of the State of New York, entitled "an act to authorise the business of banking," passed April 18th, 1838, all persons indebted to the said Association are required to render an account of all debts and sums of money owing by them respectively to me, and to pay the same by the fifteenth day of January next, at my office in the Merchants' Exchange, in the city of New York. All persons having in their possession any property or effects of the said Association are required to deliver the same to me by that day. All the creditors of the Association are required to deliver their respective accounts and demands to me by that day; and all persons holding any open or subsisting contract of the said Association, are required to present the same in writing, and in detail, to me, on or before that day, at my said office.
