May (INS)-State bank examiners today labored over the books of the Ohio State Bank here, which was closed yesterday following a heavy run on its funds. Headed by M. S. Daugherty, brother of former Attorney General of the United States, Harry M. Daugherty, the bank was capitalized at $200,000 and March 27, had reported its resources as $2,626,890. The Ohio State Bank was formed three years ago by the consolidation of the Fayette County bank, the Midland National bank and the Commercial bank. PAYMENT Of $60,000 To State By Washing ton C. H. Bank, Now Closed, Is Ordered By Court. Washington. C. H., Ohio, May 21(AP)-The Ohio State Bank today was ordered to pay to the State of Ohio, $60,000 deposited by the commonwealth before the bank closed its doors last week. The order was issued by Common Pleas Judge H. M. Rankin through whom H. Ross Ake, State Treasurer. made demand for the money, plus accrued Unless is paid, Ake is authorized under Ohio law to sell bonds deposited in the State Treasury by the bank to protect the money.

The Ohio State Bank yesterday was ordered to pay the State of Ohio $60,000 deposited by the commonwealth before the bank closed its doors last week. The order was issued by Common Pleas Judge H. M. BLANCHESTER BANK CHANGES DEPOSITORY Depositors To Be Awarded 16 2-3 Per Cent. In Few Weeks The First Citizens Trust Company of Columbus, has been made depository for the Merchants and Farmers Bank at Blanchester which closed in October. 1928. after a heavy run. The Ohio State Bank. at Wash ington C. H., was originally named depository but it also closed its doors several weeks ago. A 16 2-3 per cent. dividend declared for depositors Friday will be awarded in about three weeks, according to officials of the state banking department.

MAL DAUGHERTY NAMED BY JURY WASHINGTON COURT HOUSE, O., Oct. Fayette county grand jury investigating the failure of the Ohio State Bank and the Peoples' and Drovers Bank here today returned sixteen indictments, fiften of them against Mal S. Daugherty, former president of the Ohio State Bank and one against Virgil Vincent. local grain dealer and heavy borrower from the banks. Daugherty, brother of former Attorney General Harry M. Daugherty, came into prominence during the Teapot Dome oil reserve investigation when he refused to produce records of his bank for the senate committee which seeking funds alleged to have changed hands in the oil deal. Daugherty was indicted on fiftyeight counts, including charges of misapplication of funds, abstraction of funds, making false reports to agents appointed to examine the affairs of banks, and false reports on capital stock.

Mal Daugherty Is Indicted Today For Embezzlement Washington courthouse, -Mal S. Daugherty, president of the defunct Ohio State bank here and brother of former Attorney General Harry M. Daugherty, was indicted by the Fayette County Grand Jury late today charges of embezzlement and misapppropriation. The indictments. said to contain 57 were as the grand jury completed investigation of surrounding the closing of the Daugherty bank and Peoples & Bank. Many Depositors Sue Ohio State Bank for Damage COLUMBUS, O., Jan. 9. (INS) Placing responsibility for the failure of the Ohio State Bank, of Washington C. MOTHER OF DAUGHERTY DIES IN OHIO, AGE Washington Courthouse, Ohio, Feb. Jane Daugherty, widowed mother of former Attorney General Harry M. Daugherty, and Mal Daugherty who on trial here for alleged misapplication funds while president of the closed Ohio State bank, died at her home early today. She was 95 years old. Mrs. Daugherty, one of the signers $40,000 bond for her son, Mal, had been ill only four days from influenza and heart disease. Indications were that the trial Mal would be continued until after his mother's funeral. It was delayed late yesterday until this morning when Judge Charles Bell who hearing the case learned of the seriousness of the banker's mother's illness. She had been widew for years.

LAST CHARGES AGAINST MAL DAUGHERTY VOIDED WASHINGTON COURTHOUSE, Ohio, Jan. 3.β€”The last two indictments against Mal S. Daugherty in connection with collapse of the Ohio State Bank here, were dismissed by Common Pleas Court today at the State's request. Daugherty, former president of the bank, was sentenced to 10 years imprisonment and fined $5,000 on a charge of misapplication of the bank's funds and was granted a new trial by the appellate court. A hearing on the State's motion to review this case now is pending in the Ohio Supreme Court. The indictments dismissed today charged Daugherty misapplied funds totaling $6,250 in two transactions.
