Some of the depositors of the closed Bank of Cowpens have voiced objection the pointment Martin, succeeding ColRoss, of Gaffney, resign- The appointment of Mr. Martin made here Monday by Judge Mauldin. Petition Withdrawn For Bank Receiver SPARTANBURG June Judge Ramage. sitting in Union. med an order which has been on file in office of clerk of court here. permitting the withdrawal of petition for receiver for M Moseley. Cowpens merchant and former president of the Cowpens Security bank. now defunct The petition was filed with the court by W. Hall. representing receivers of American State Bank of Gaffney and argued before Judge Ramage who refused the motion on the grounds that he found nothing for the receiver to take but the premises, which are under mortgage and the cost of the receivership would have to come out of the proceeds of the foreclosure. Subsequent to that decision. Mr. Hall asked that he be permitted to withdraw the petition which request was granted in the order.

Albert S. Fant Sued In Closing Of Cowpens Bank Receiver Seeks $40,000 leging Neglect Of Duty By State Examiner MANY IRREGULARITIES SPARTANBURG, Dec Claude R. Dunbar, receiver of the Cowpens Security bank, which was closed April today filed suit with the clerk of court here against Albert Fant, state bank examiner, and the Fidelity and Deposit company of Maryland for the sum of $40,000. The complaint filed by Harvey W. Johnson, attorney for the plaintiffs, points out that Fant through the Fidelity company for $15,000. pledging faithful performance of his duty. CHARGED WITH FAILING DUTY. Receiver of Bank of Cowpens Seeks Recovery for Alleged Excessive Loans to Officers. Spartanburg, Dec. Fant, state bank examiner, and his surety, the Fidelity and Deposit Company, of Maryland, are made joint defendants in $40,000 damage suit filed here in Tuesday connection with the failure of the Cowpens Security Bank, of Cowpens, April 30, 1929. complaint alleges that Mr. Fant "failed to perform duties, that he failed remedy or discontinue said illegal practices and, after the said bank became insolvent and the conduct the failed take and retain of the assets of said bank and place the affairs of the same in the hands The action brought by Harvey attorney, senting Claude R.
