FORECLOSURE IN BUTLER SOUGHT Judge Kepler Presides at District Court Case at Allison. ALLISON. July 13 Judge M H Kepler of Northwood held court here in the case o: Ernest Hook receiver of the co-partnership of Reints and DeBuhr. who operated a private bank at Aplington known as the Exchange bank. The receiver is foreclosing a $6,000 first mortgage against 80 acres of land owned by Egbert Eckhoff Sr Henry Eckhoff and daughter Mrs. Jennie Reynolds are also defendants and intervenors, claiming a $6,000 mortgage given by Egbert Eckhoff individually to himself as trustee and which mortgage appears of record to be a second mortgage is a first mortgage in reality because Egbert Eckhoff as trustee is claimed to have had no authority to release it It is claimed by the receiver that this is a collateral attack on a judgment of the Hardin county district court. which, in a probate matter discharged Egbert Eckhoff and thereby impliedly held that the will in that matter did not make Egbert Eckhoff a trustee and therefore he needed no authority to release the trustee mortgage The receiver also claims his rights to his first mortgage of So. 000 are subrogated to rights of a mortgage which was prior or superior to other mortgages because the receiver's $6,000 paid part of said superior mortgage Friend husband doesn't mind shopping with his wife It's the only time he gets enough of studying himself in mirrors -Dubuque Telegraph-Herald.
