FORMAL APPLICATIONS DENVER, Colo., July 5—UP—Formal applications for commutation of their sentences from death to life imprisonment were filed today with Governor W. H. Adams by the trio of Lamar bank bandits. The three men, Ralph Fleagle, Howard Royston and George Abshier, are in the state penitentiary at Canon City awaiting execution for two murders committed during the robbery of the First National bank at Lamar, in May, 1928. Fleagle's execution is set for the week ending July 12, while Royston and Abshier are to be hanged the week ending July 19. BANK REOPENS BATTLE CREEK, Nebr., July 5—UP—The Battle Creek valley bank which suspended business for a time while reorganization was being effected, was again open for business under its newly formed organization. BRYAN LISTS ATTORNEYS The controversy now at its height between Governor Bryan and Bank Receiver Clarence Bliss in which the governor is accused of such interference in the labors of the receiver that the latter attempted removal of his office from the co-operation of the state banking department has prompted Governor Bryan to publish the names of the attorneys who have been employed by the receivers and the amounts paid to them in the past. The Governor recently suggested list of attorneys who should be given preference in receivership cases and as these men were of the gov. ernor's political faith, decided ob jections were voiced by the receiver. NORFOLK MAN FOUND DEAD City authorities at Norfolk were called the home of Gus Bartholoto mew on Monday to ascertain if possible the cause of death of Hillard Bartholomew; 24 years old, whose body was found in the home garage by his father. From all indications the young man had committed suicide. Examination by the authorities proved that he had taken the car belonging to his father on Sunday evening without the knowledge of his parents and contrary to instructions from them. He had been out late in the evening and overturned the car. It was also learned that he had been drinking. The body of Bartholomew was found lying near the exhaust of the car; all doors to the garage were closed.

Five Banks Pay Dividends Payment of special dividends realized from assets of five failed banks to the depositors of those institutions is announced by the state bank receivership division, as follows: Battle Creek—Battle Creek Valley bank, 5 per cent, $14,300; previous payment, 15 per cent, $42,901; total, 20 per cent, $57,201. Bruno—Bruno State bank, 10 per cent, $12,189. Chadron—Chadron State bank, 5 percent, $22,686; previous payment, 15 per cent, $68,058; total, 20 per cent, $90,744. Loomis—Farmers' State bank, 10 per cent, $7,163; previous payments, 45 per cent, $32,235; total, 55 per cent, $39,398. Sterling—Farmers' & Merchants' bank, 10 per cent, $7,060; previous payments, 46 per cent, $32,592; total, 56 per cent, $39,652. In the case of the bank at Sterling, 58 per cent of its original deposits were withdrawn while the bank was being operated by the old guaranty fund commission. The percentage since paid are based on the amounts due depositors when receivership began.

The Crawford State bank suspended business Oct. 21. The new officers are O. R. Ivins, president, S. P. Duncan, vice president and cashier. The capital stock is $30,000, surplus $10,000 and undivided profits about $3,000. The bank reopened with deposits of $160,957. The depositors have co-operated in the reorganization by signing waiver contracts agreeing to accept payments of their deposits in monthly installments but all depositors are to be paid in full and without any write-down. Dividends to depositors of the Farmers State bank of Loomis, upon order of the district court, dated Dec. 2, totals $7,163.37, or 10 percent. During receivership 45 percent or $32,235, had previously been paid. The Battle Creek Valley bank at Battle Creek will now pay a 5 percent dividend or $14,300.32.
