APPEALS CLAIM. The $15,500 claim of John Lusher of Seward county, against State Bank of Bee, disallowed by the district court as a claim having priority over other deposits, has been appealed to the supreme court. The lower court held that the certificate of deposit was allowable only as a general deposit. The bank receiver had alleged that it was issued to deceive bank examiners and the state banking department, that it had been agreed between Lusher and the bank that he should have 5 percent interest, which was 1 percent higher than the law allowed, that the claimant had accepted the excess rate and that the certificate was void. The court classed it as a general claim drawing 4 percent.
