GUARANTY FUND APPEALS Objects Orders Allowing 000 of Claims Against It Court. Attorneys for the guaranty fund commission appealed Saturday the supreme court from orders the Sheridan county district court in favor the American Life company of and for favor of Nels The claims were against the failed Clinton State bank. The contention of the guaranty fund commission that the life insurance not satisfied with the security existing at the time the money into the bank deposit, required the bank execute an indemnity bond. This signed four the stock holders. This constitutes agreement that deposit had been otherwise secured. Under the law it has existed since the last amended the original, agreements takes the deposit out from under the protection the fund. is argued by the commission torneys that the claim of the insurance has not yet been adjudicated. this applies, but the court below held that did not, since the deposit was made prior the enactment of the law Tausan claim is based on the the officers of the bank taking eleven liberty bonds had safe and using them collateral the federal bank. COURT CONVENES The spring term of District Court for Sheridan County convened in this city Monday with Judge E. L. Meyer presiding and Scott, Reporter. At the call of the docket more than the usual number of attorneys were in attendance. No criminal cases will be tried this term. There were three on the docket. John Waldron, charged with auto theft, broke jail last has not yet been apprehended. In the case of Nebraska vs. R. H. Peters and one Studebaker coupe, the case was dismissed and the released, for the reason that the State had no evidence whatever against the many witnesses of the defendant to the defendant's claim that the car was stolen from him Norfolk. The car had been captured at Gordon, charged with illegal transportation of liquor. No action was taken in the case of State vs. Chas. Hindman, desertion charge, the execution issued has not been returned. The civil docket comprises 106 cases, of which the following have been acted upon as go to press: Cases Continued Belle W. Adam Kaxhaus, restraining order. costs Court will continue the balance of the week to hear as many of the cases on the docket as possible, with the view of clearing the docket many old cases. The Ccurt has announced that he will call the jury back again for further court on Monday, February 24, 1930. Court will likely be adjourned Saturday night until the above date. Of the many cases pending on the docket, none have general public interest, the questions involved cerning more largely the parties in interest and their attorneys. There are 27 cases for divorce pending on the docket.
