LIABILITY RULE GIVEN 'Deposits in Bank Not OffSet for Depositors Stockholders in closed state banks may not escape double liability by off's-ting deposits they had in the bank when it closed, District Judge James E. Coffey decided in the case of C. H. Reimers, receiver for the Citizens State Bank of Pingree against C. H. Simpson. The case is typical of many other cases arising from closing of banks in the state, C. L. Young, attorney for the Guaranty Fund Commission and for Mr. Reimers in this case, said today. The receiver sought to collect $1,125.00, double liability, costs and interest. Mat. Simpson had certificates of deposit in the bank when it closed, and he claimed that these must be counted as an off-set to the stock liability. Another case of liability of bank stockholders, Mr. Young said, is pending before Judge Berry in the Stark district court. In this case Chas. F. Kellogg, receiver of the Citizens State Bank of Hazen, sought to compel J. A. Hollst to pay additional liability. Hollst, in a demurrer, argued that the additional ,liability could not be claimed where the examiner had not ordered an assessment, the demurrer being overruled and the case remaining in court for final trial.

depositors of the first 58 banks which closed has been increased in several instances by dividends of the receiver of closed banks. Depositors of the People's State bank of Hatton received 100 percention the dollar of their deposits, and depositors of the People's State bank of Leith have received 60 percent in dividends from the receiver and 10 percent from the depositors guaranty fund commission. Other banks on which dividends have been paid by the receiver, in addition to the 10 percent of the depositors guaranty fund commission, are: Security State bank of Columbus, 10 percent; Fortuna State bank, 30 percent; Prosper State bank, 10 percent; Citizens State bank of Hazen, 10 percent; First Farmers of Minot, 10 percent. The first 58 banks which closed. on which the guaranty fund dividend was paid, included several of the largest banks which closed, among them the Scandinavian-American bank of Fargo, the Williams County State bank of Williston and the First Farmers of Minot.

HAZEN BANK PAYS DIVIDEND Announcement that a second dividend of 10 per cent is being paid to creditors of the closed Citizens State bank of Hazen was made here today by L. R. Baird, receiver of closed state banks. Payment is being made through the office of P. A. O'Keefe, district manager for the receiver here.
