BANK RECEIVER SUED FOR DAMAGE (Continued From Page One.) creditors, which provided that Sherman Hall and Leva Hall turn over for the benefit of creditors, four joint stock farms, Loan Bonds of the value of $1000 each, which complaint alleges they did, that said creditors including said Union State Bank as receiver, agreed that such payment would discharge, release and fully satisfy all indebtedness of said Sherman Hall as set forth in the complaint. It is further alleged that said bank as receiver filed a petition with the judge of the circuit court in vacation asking permission to enter into such an agreement and approve its action and that said court did approve same. On June 19, 1924, it is alleged said Union State Bank as receiver signed a praecipe for an execution, which was duly executed and Sheriff Sneed, acting as Sheriff of Jackson county, levied on personal property of Sherman Hall, consisting of growing crops and farm tools and sold same under said execution, all of which was contrary to the agreement entered into between the plaintiff and Union State Bank as receiver of the Citizens State Bank for which the plaintiff asked $1000 damage. Two damage suits resulting from the same automobile accident are among the new cases filed the past week, in which County Commissioner Jas. R. Crabb is named as defendant. The plaintiff in one case is Albert Fields, ex-mayor of Bedford, who asks $500 damage to his automobile. The other plaintiff is Geo. Fields, who was riding in the Fields car at the time of the accident, who asks $1000 for personal injuries. The accident August 31, 1925, on the road, when the Crabb and Fields cars collided about two miles east of Brownstown. The complaint alleges that the defendant failed to signal when he started to make left turn into a side road, and in doing SO the two cars crashed together. Other New Cases Flora Henderson vs, Arthur Henderson; divorce. Plaintiff also asks care and custody of their five children $15 per week for support for the three youngest children. H. Williams & Son vs. Maurice Whiteford; on note, demand $100. Russell Baker vs. Goldie Baker; divorce. Parties were married June 25, 1910, and separated May 6, 1925. Laura Hulse VS. Chas. Hulse: divorce. Parties were married November 7, 1908, and separated October 5, 1925. Ernst Bros. VS. Jacob Bowman, on account; demand, $75.

Bruce Gallion Fined $1 and Costs As Result of Reported Fight At Rockford. MARCH TERM STILL QUIET Judicial Business Slow At Browns- New Cases Have Been Filed. The case of Bruce Gallion, storekeeper, of Rockford, charged with assault and battery with intent to commit murder, which was turned over to circuit court following hearing here in city court during the latter of December has terminated by the trail in circuit court. Gallion after entering not guilty. was found guilty by jury and fined $1 and costs. Gallion was arrested by local police after an alleged fight in the store at Rockford said to have arisen over an onion in which John Findley, north of Seymour, was wounded. The defondant was placed on the case here. under $1,000 bond at the hearing The March term continues quiet, with little business of unusual im portance. Several new cases have been filed and others set down for trial. Recent court business includes the following: Citizens State Bank, Brownstown, files suit against Eva Banks, et al, on note and mortgage, demand $500. Charles L. Smith vs. Aretus Shepherd, et al., on notch trial by court and finding for the plaintiff and judgment rendered in the sum of $142.03. Sherman Hall et al. vs. Union Do State Bank, receiver, et al., for damages and mandate; cause set for trial on March 20. State ex rel., George C. MeDonald vs. Marion F. Davis, trusted, for mandate; John W. Craig qualifies as special judge and assumes jurisdietion. Frank L. Schornick, receiver, vs. Nora McGill, et al., in partition of real estate: cause set for trial on March 27. Frank L. Schornick, receiver, vs. Fred A. Garriott; John E. Craig qualifies as special Judge and assumes jurisdiction. William Eikenbery vs. Charles V. Long, et al., to foreclosure; cause dismissed on motion of the plaintiff. In the matter of the receivership of the Citizens State Bank, the receiver reports of certain real estate to Frank L. Schornick in the sum of $2,000; report and deed approved. Bruce Scott vs. Fern Scott, to annull marriage; trial by the court and taken under advisement. State vs. Claude Edwards, for non-support; bond fixed at $300; same filed and approved.
